Terms and conditions

What you get, what it costs, when you pay, and what happens if either of us wants to stop. Written to be read, not to be skipped.

1. Who you are dealing with

Anvil Works is a partnership between Otto Hallinan and Maximilian Tooke, of 17 Undercliff Road West, Felixstowe, Suffolk IP11 2AN. Email anvilworks.co.uk, telephone 07915 798255. We are not VAT registered, so the prices below are the total amount payable.

2. How the free build works

• We have a conversation about your business. Nothing is owed for this.
• We build a complete, working website and show it to you, normally within 7 working days for Starter and 12 to 15 for Premium. Nothing is owed for this either.
• You look at it, ask for changes, and decide whether you want it.
• If you say yes, you pay and we put it live. If you say no, we stop, you owe nothing, and we take the site down.

We may decline to start a free build, or stop one, if we think the work is outside what we do or the information we need is not going to arrive. We will say so early rather than waste your time.

The one-off build charge is payable by bank transfer within 14 days of the site going live, unless we agree otherwise in writing. We do not take a deposit, and nothing is payable at all if you decide you do not want the site.

What the £15 a month covers. It starts in the month the site goes live and it covers all of the following, so that nothing else is billed to you:

• Hosting, and the security certificate that puts the padlock in the address bar.
• Your domain name, including registration and every renewal, for as long as you are with us.
• Backups, and fixing anything that breaks.
• Changes to the site: prices, opening hours, staff, services, new photos. One set of changes a month. Send us everything you want doing in one go and we will do it. This is not charged per change, and unused months do not stack up.

What it does not cover is building something new that was not part of the original site, such as an extra page, online booking added later, or a shop. We quote that separately, in writing, before doing it.

If the one-off charge, or a monthly payment, is more than 30 days late we may take the site offline until it is paid, and we may charge statutory interest and a fixed recovery sum under the Late Payment of Commercial Debts (Interest) Act 1998.

4. What we need from you

• Your prices, opening hours, services and contact details, and someone who can confirm they are right.
• Photos, logos and any wording you want used — and confirmation that you have the right to use them. We rely on that confirmation.
• Replies within a reasonable time. If we hear nothing for 30 days we will treat the build as paused and may close it.

5. Changes and revisions

Starter includes three rounds of changes: a first draft, your notes applied, and a final pass. Premium includes unlimited rounds until you are happy with what was agreed at the start.

"Unlimited" means unlimited refinement of the site we agreed to build. Adding pages or features that were not part of the original conversation is new work, and we will quote it separately before doing it. Those rounds are the build. Once the site is live, changes move onto the monthly and run at one set a month, as set out in section 3.

6. Who owns what

• Once you have paid, the finished website is yours — the design, the code and the content. We will hand over everything needed to move it elsewhere if you ever want to.
• Before you have paid, it remains ours.
• Anything you gave us — your photos, your logo, your words — stays yours throughout.
• We may show your finished site in our portfolio and say we built it. Tell us if you would rather we did not, and we will not.
• We reuse our own underlying code and techniques on other projects. That does not include anything specific to you.

7. Domain, hosting and running costs

While you are paying the £15 a month, we pay for these and you do not see a bill for them. That covers the domain name and every renewal, the hosting, and the security certificate.

The domain is registered in your name, so you own it even though we pay for it. If you stop the monthly we transfer it to your control at no charge, and from that point the renewal is yours to pay, directly to the registrar. It is roughly £10 to £15 a year and it is not paid to us. If a domain is allowed to lapse after it has been handed over, the site stops working and the name can be bought by someone else, and that cannot be undone.

8. After it goes live

We will fix anything broken that is our fault free of charge, for as long as you are paying the monthly. Changes you want made are included too, one set a month, as set out in section 3.

Once you have stopped the monthly, changes and fixes are charged. Most are between £20 and £50 depending on the size of the job, and anything larger is quoted as a fixed price. Either way we tell you the price before we start.

We do not guarantee any particular position on Google, any number of enquiries, or any level of sales. Anyone who does is guessing.

9. Stopping

Before you have paid anything you can walk away at any point, for any reason or none, and owe nothing.

The first six months are committed. From the month the site goes live you are agreeing to at least six monthly payments. That is what makes it possible for us to build the site first and charge nothing up front.

After six months you can stop whenever you like. Tell us by email or message and we will take the final payment one month later, then stop. You do not have to give a reason and there is no fee for leaving.

What you get when you stop. Everything, at no charge:

• The domain name transferred into your name. It is yours.
• The complete website files, so the site can go on any hosting you like. We will help you move it, or move it for you.

From then on your only cost is the domain renewal, paid by you directly to the registrar. That is roughly £10 to £15 a year at today's prices, and it is not paid to us.

We are still here afterwards. Changes are no longer included once you have stopped paying, but if you want something changed or fixed that you cannot do yourself, get in touch. Most jobs are between £20 and £50 depending on the size of it, and we tell you the price before we start so you can say no. Larger work is quoted the same way it always was.

You are not tied to us either way. It is ordinary HTML and CSS on hosting in your name, so any other developer can pick it up.

If your business closes or is sold during the first six months, tell us. We will not chase payments from a business that has stopped trading, and we will hand the domain over.

We can stop working with you if you ask us to do something unlawful, if you are abusive to either of us, or if an invoice goes unpaid.

10. Your cancellation rights

If you are contracting as a business, the consumer cancellation rules do not apply. Before you pay anything you can stop at any time. Once the site is live, the first six months of the monthly are committed and after that a month’s notice ends it, as set out in section 9.

If you are a consumer rather than a business, and we agreed the work away from our premises or entirely at a distance, you have 14 days to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If you ask us to start within those 14 days and we finish the work, you lose the right to cancel once it is complete. To cancel, email us — a clear statement is enough.

11. What we are and are not responsible for

We will build your site with reasonable care and skill, as the Consumer Rights Act 2015 and the Supply of Goods and Services Act 1982 require.

We are not liable for lost profits, lost business or lost data. Where we are liable, our total liability is limited to the amount you have paid us for the work in question. Nothing here limits our liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow us to limit.

We are not responsible for downtime at your hosting or domain company, changes Google makes to how it ranks sites, or content you asked us to publish.

12. Complaints and law

If something is wrong, ring or email and tell us — we would far rather fix it than argue about it. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
